Collection of Personal Information
Software and Services. You need a PointAcross account to use the Software and Services. PointAcross, Inc. requires some limited personal information to create a PointAcross account, including your first name, last name, username, e-mail address, birth year, postal code and password, which are used to protect your account from unauthorized access. PointAcross, Inc. also requires minimal financial information (e.g., credit card number, expiration date, billing address, etc.) when you seek to acquire a license for any Software or Services, which is used exclusively for billing purposes.
PointAcross Account Manager (aka My PointAcross) stores, processes and maintains your PointAcross messages and other data related to your PointAcross account in order to provide Services to you. When you use the Software or Services, certain information about your use is automatically recorded and retained, such as account activity (e.g., storage usage, number of log-ins), data displayed or clicked on (e.g., UI elements, ads, links), and other log information (e.g., browser type, IP address (numbers assigned to identify computers on the Internet), date and time of access).
When you send a PointAcross message, PointAcross, Inc. records and retains information, including message header information, your content file(s), certain PointAcross, Inc. account information and your IP address.
When you view and listen to a PointAcross message, you follow a URL to a web page hosted by PointAcross, Inc. that plays a PointAcross viewer on that web page downloaded to your computer or other device. PointAcross, Inc. receives and retains the message header information, certain PointAcross, Inc. account information, and your IP address, as well as content identifiers of the content you view and the date and time of viewing.
Web Sites. We also collect information volunteered by visitors to our Web Sites, such as by completing and submitting our online forms or emailing us. When visitors use our Web Sites, our servers automatically collect certain information that the browser sends when visiting Web sites in general. This log file information may include the URLs you visited; your IP address; date, time, and time spent on pages visited; and information about your browser and platform.
Cookies. From time to time, our Software, Services and/or Web Sites may use the standard cookies feature of major browser applications which allows us to store a small piece of data on your computer about your use of our Software, Services and/or Web Sites. Cookies help us learn which portions of our Software, Services and Web Sites are useful and which need improvement, among other things. You can choose whether to accept cookies by changing the settings on your browser. However, if you choose to disable this function, your experience with our offerings may be significantly diminished and many features may not operate.
We use the personally identifiable information and aggregate information we collect to maintain your PointAcross account and market and provide the Software, Services and Web Sites to you, to improve our offerings and to create new offerings. We also may use your name and logo publicly or privately in our online or offline customer lists, presentations, advertising and promotional materials, and/or financial reports, unless otherwise agreed in writing by us.
We do not use your personally identifiable information to send commercial or marketing messages to you (such as offers regarding Software or Services) without your consent or opt-in. We may send you certain service and administrative notices, which are not subject to opt out.
We do not sell, rent or otherwise share your personal information with any third parties except in the following limited circumstances. We may share such information if we in good faith believe that such action is necessary to: (a) comply with any law, regulation or order, such as subpoena, court order or search warrant; (b) provide the Software, Services, and/or Web Sites using our affiliates or subcontractors under confidentiality agreement;(c) protect and defend the rights or property of PointAcross, Inc., including investigations and defense of third-party claims; (d) otherwise ensure compliance with PointAcross, Inc. customer agreements and policies; and/or (e) protect the rights, property and personal safety of PointAcross, Inc. users, staff or the public. Your name and logo may be publicly available as described above.
Aggregate information, such as log file information, also may be shared with business partners and advertisers only on an anonymous aggregate basis.
PointAcross, Inc. reserves the right, in the event all or any relevant portion of the stock, business or assets of PointAcross, Inc. is transferred to, acquired by or merged with any third party, to transfer or assign as part of such transaction any or all of the information we have collected.
Account Corrections and Cancellation
You may cancel your PointAcross, Inc. account and/or change your account settings through the Customer Login section on www.pointacross.com. You may organize and/or remove your stored messages using your account management feature. Such changes generally take immediate effect. Residual copies of deleted messages and terminated accounts may take up to 60 days to be deleted from our active servers and may remain in our offline backup systems. However, we may retain any information to the extent required by law or otherwise in connection with the permitted information sharing described above.
The Software, Services and Web Sites and content on them contain links to other sites and resources controlled by third parties. PointAcross, Inc., is not responsible for privacy practices or content of these other sites or resources, and you should consult the privacy statements of such other sites and resources. PointAcross, Inc. reserves the right to engage third party ad server companies whose policies may govern access to any ads or links made available to you.
Our Software, Services and Web Sites have security measures in place to prevent the loss, misuse, and alteration of the information that we obtain from you, but we make no assurances about our ability to prevent any such loss, misuse, to you or to any third party arising out of any such loss, misuse, or alteration.
The Web Sites are hosted and the Services are provided in the United States of America and are intended for and directed to customers in that country. If you are accessing the Web Sites or Services from the European Union, Asia, or any other jurisdiction with laws or regulations governing personal data collection, use, and disclosure, which differ from United States laws, please be advised that through your use of the Web Sites and Services, you are transferring your personal information to the United States of America and you consent to that transfer.
